Abbott Locked the Door Texas Left Open

The governor's 'audit' of 474 GW in ERCOT queue requests has no end date and no transmission fix behind it. The pattern points to Texas being closed for the foreseeable future, not paused. Every site-selection model built on the Texas default needs a rewrite today.

The industry read on Abbott's August 3 executive order is that Texas is slowing down temporarily. Audit clears, queue moves, data centers get built. That read is almost certainly wrong.

Governor Abbott directed state regulators on Monday to audit every data center advancing through ERCOT's interconnection process, preventing affected projects from moving forward until the review is complete. Neither ERCOT nor the PUCT has announced an official timeframe for completing the compliance reviews and resuming project approvals. No timeline is not an oversight. It is the design.

The audit is real. The exit from it is not.

What Is Actually in the Queue

ERCOT is currently tracking more than 1,800 projects in the queue, representing over 474 gigawatts of electricity, or more than five times the grid's record for peak demand. Abbott's office said data centers represent about 90 percent of the requested capacity and that the prospective load could threaten grid reliability.

The official line is energy and water. Translation: we will study this until the political problem goes away or the election happens.

The real problem is transmission. With the increasing number of large loads seeking to connect to the grid, ERCOT and utilities cannot keep up with the required transmission planning. The current system, built for a large load queue totalling 40 to 50 projects, is now bogged down by the 225 new interconnection requests ERCOT received last year. ERCOT can generate power. It cannot reliably move it to where data centers want to land.

An ERCOT spokesperson said the grid manager is reviewing Abbott's order and will postpone the Batch Zero transmission planning study that is currently underway. Batch Zero was the one structured attempt to evaluate multiple large-load requests simultaneously. The Public Utility Commission of Texas approved rules for the state's grid operator to begin reviewing an initial set of large load interconnection requests, known as Batch Zero, on June 18, 2026. It lasted forty-six days before the audit suspended it.

The transmission fix that would clear the queue requires more than spreadsheets. ERCOT's planning documents show that the initial $9 billion for its 765-kV Strategic Transmission Expansion Plan is only a down payment on a package pegged at about $32.99 billion and calling for roughly 2,468 miles of new line. The early work, covering initial buildout and permitting, is expected to play out over about five to six years, although the actual pace will depend on permits, supply chains, and utility construction capacity.

Five to six years at best. That is the physical constraint hiding behind the audit.

What the Pattern Points To

The most likely explanation is not that Abbott found a compliance gap. It is that grid operators have communicated, in whatever form regulators deliver inconvenient facts, that the transmission backbone required to absorb the queue does not exist and cannot be built on a timeline that fits capex plans.

Abbott also has an election problem. A Senate committee is looking at how much revenue the state may have lost by giving tax exemptions to data centers. Abbott noted that the audit was triggered in part because several data center operators failed to comply with a state survey measuring water and power usage. That is political cover dressed as regulatory diligence.

If you have Texas in your 2026 to 2028 capex plan and you are not activating alternatives today, you are not paying attention.

Where the Queue Goes Next

The demand driving 474 GW of requests is real, even if a significant fraction represents speculative queue-holders. The load has to go somewhere.

The Midwest states—Indiana, Ohio, Iowa—offer perhaps the fastest build timelines, with some projects reporting permit-to-completion timelines of 14 to 20 months. This speed advantage is significant for hyperscale operators under pressure to bring capacity online quickly. Ohio emerged as a major data center hub in 2024 to 2025, driven by Google's $10 billion-plus investment in Columbus-area campuses. Electricity rates average 6.9 cents per kilowatt-hour from AEP Ohio, and the state offers a 100 percent sales tax exemption on data center equipment. Iowa recorded zero permitted projects in 2022, 2023, and 2024, then suddenly added 6 projects and more than $3 billion in declared project value in a single year.

Virginia is congested but experienced. Northern Virginia remains the world's largest data center market, but power wait times averaging seven years for large loads are pushing developers to look elsewhere. At least it has existing fiber, talent, and utility relationships.

Texas real estate priced on data center demand is the asset class most exposed to a longer freeze. That land does not re-price quietly.

What to watch: Whether the Batch Zero study gets a rescheduled date before Q4 2026. If it does not, the market will read that as a signal, not delay. Watch also for hyperscaler announcements in Ohio, Iowa, and Indiana through year-end. If those accelerate while Texas requests sit unanswered, the market has already voted.
